During the week of July l4, FURA took depositions of three District employees who have been involved in administering some aspect of retiree health benefits. The District also took depositions of two former FTA negotiators, who were involved in early FTA collective bargaining agreements. One deposition was not completed, and will resume in early September.

During one deposition, FURA’s attorneys (Robert J. Bezemek and David Conway) played a recording, supplied by a retiree/FURA member, of a district official telling a group of more than 200 prospective early retirees, in 1996, that:

“If you are not 571/2, the lifetime medical benefits does not apply to you until you become 571/2. So, if you otherwise have the ten or sixteen years of required service, you may become eligible and you are over 50, you may buy those benefits at the COBRA rate…

There are no monthly premiums, however, after the age 571/2…and this coverage applies to you and your spouse..”

In the deposition, FURA attorney Bob Bezemek was able to get confirmation of the speaker’s identity. On September ll, 2008, at 3:30 p.m., the Fresno County Court will conduct a “case management conference” to review the case status and progress. FURA members are invited to attend this case management conference in The Honorable Donald Franson, Jr.’s courtroom in the new Fresno County Civil Courthouse on Tuolumne (site of the former Casa Blanca Banquet Hall). Parking is very convenient and plentiful at the new Civil Court House.

FURA’s legal team appreciates the many retirees who have recently shared important information very useful in the pursuit of this case.
